Our Privacy Commitment
PointMMO Pte Ltd. ("PointMMO," "we," "us" or "our") is committed to respecting the privacy rights and concerns of all users of the PointMMO websites where this Privacy Policy is posted (the "Site(s)"), the PointMMO plugin that progressively downloads Games obtained through the Site(s) (the "PointMMO Plugin"), the PointMMO social network available through the Site(s) (the "Social Network"), and the services otherwise made available through the Site(s) by PointMMO (collectively with the Sites(s), the PointMMO Plugin, the Social Network and the PointMMO Virtual Currency, as the "PointMMO Features"). The Site(s) also offer third party services that are not provided by PointMMO, including video games (the "Games") made available through third party publishers ("Publishers"), a social networking software tool known as "Overwolf" that allows users to access certain social networks directly while playing the Games ("Overwolf") As such, we have established and implemented this Privacy Policy to inform visitors to the Site(s) and users of the PointMMO Features how we use and protect the information we collect through the Site(s) and PointMMO Features. By visiting the Site(s) or using any of the PointMMO Features through the Site(s), you consent to PointMMO's collection, use, storage, deletion and disclosure of information relating to you as set forth in this Privacy Policy. This Privacy Policy is effective as of the date set forth above and is only applicable to the Site(s), the PointMMO Features, and our use of your information in association with the the PointMMO Features, but not to any other website, video games, or software programs that you may be able to access from the Site(s), which may have their own data collection and use practices and policies.

What information do we collect about you and how do we use it?
Types of Information We Collect
Personal information means information that can be used to identify and contact you. You do not need to submit personal information to access certain areas of the Site(s), but if you do not want to disclose certain personal information to us, you will not be able to access certain aspects of the PointMMO Features. We collect personal information when you create an account in order to access the PointMMO Features ("Site Account"); subscribe to our newsletter; participate in forums, chat rooms, and surveys; participate in contests, sweepstakes, or other promotions; purchase a Game through the Site(s); use the PointMMO Plugin to download Games through the Site(s); sign up for our PointMMO Virtual Currency; sign up for and utilize the Social Network; send and receive messages from other users of the PointMMO Features; file a complaint; provide customer feedback; request customer or technical support; or send other communications to us from time to time. Personal information collected may include your name, email address, date of birth, mailing address, phone number, a photo of you, a brief description about yourself, and other personal information you decide to share through the public features of the Site(s) or in your messages. We may also ask you to provide additional information such as a screen name, a password, your gender, your hobbies, your occupation, your platform preferences, other game ownership information and other information and/or preferences you may provide from time to time in association with your Site Account or Social Network profile. This additional information may be associated with your personal information. When signing up for an account to access the PointMMO Features or the Social Network, you may associate your third party social networking accounts, for example your Facebook account ("Third Party Accounts"), with your Site Account. When you associate one or more of these Third Party Accounts with the your Site Account, we receive certain information from your Third Party Accounts, which may include your user name for such Third Party Accounts, your age or age range, locale, friends list, gender, other publicly available information provided through your profiles on your Third Party Accounts, and any other information such Third Party Accounts may provide from time to time. When you use the PointMMO Plugin we will receive information regarding your IP address, download speed, computer specifications, operating system, internet connection, and other user activity related to the download of the Games. Your IP address is a unique set of numbers that identifies your computer when it connects to the Internet.
How We Use Your Personal Information
The personal information and any additional information you provide to us will allow us to fulfill your Game order through the PointMMO Plugin; alert you of new products or services, features, or enhancements; provide you access to the Social Network; create your profile on the Social Network; provide you earned PointMMO Virtual Currency; provide regular newsletters; handle/route your customer service questions or issues; request feedback and provide surveys; and/or notify you of upgrade opportunities, contests, promotions, or special events and offers. We also use your e-mail address to send you messages about the PointMMO Features and other general announcements. We keep track of your interactions with us, including but not limited to your activity within the PointMMO Features. We may use personal information that you provide to us to send messages to you in response to your request to perform an activity in connection with your use of any of the PointMMO Features. We may also use your personal information to contact you when necessary. We use the information obtained from your Third Party Accounts to enable you to integrate into the PointMMO Features and Social Network more easily by merging some of the information from your Third Party Accounts into your Site Account and Social Network profile with your permission. Additionally, we may provide you an opportunity to invite your friends to the Site(s) and Social Network. You will also be given the option to share certain aspects of your experience with the PointMMO Features through your Third Party Accounts from time to time. The information we obtain from your use of the PointMMO Plugin will be used to assess your use of the PointMMO Plugin, assess the performance of the PointMMO Plugin, and to maintain and optimize the PointMMO Plugin.
Cookies
"Cookies" are small bits of electronic information that a website sends to a visitor's browser and are stored on the visitor's hard drive. Like many websites, we employ cookies in certain areas of the Site(s) to allow us to provide information which is targeted to your interests and to make your online experience more convenient. For example, when you return to one of our websites after logging in, cookies provide information to the website so that the website will remember who you are. Some of our common uses of cookies include saving your shopping cart, saving your login name and passwords, keeping track of your click streaming data, tailoring web content and advertisements to your interests, and personalizing the Site(s). Should you disable cookies in your browser, you may not be able to access certain PointMMO Features or areas of the Site(s).
Log Information
Our servers automatically record information that your browser sends whenever you visit the Site(s). This information includes your IP address, your browser type and version, the search engine you used to find the PointMMO Features, if any, the operating system your computer uses, which PointMMO Features you use and when and how long you use them. We use this information to monitor and analyze how users use the PointMMO Features, to provide customer service, and to maintain and improve the PointMMO Features. Please be aware that advertisers or websites with links to and from our Site(s) may collect personal information about you (e.g., Google analytics). This Privacy Policy does not apply to those advertisers or websites, and you should look at their privacy policies for details of their use of your information.
Children's Privacy
We do not knowingly collect personal information from children under 13. We take children's privacy seriously, and encourage parents to play an active role in their children's online experience at all times.
Will we share your personal information with third parties?
Sharing of Information
We may use your personal information to provide analyses of our users in the aggregate to prospective partners, advertisers and other third parties. We may also disclose and otherwise use, on an anonymous basis, affiliation, position, interests and other non-personal information about customers.In addition, we will share the personal information we collect from you under the following circumstances:
- Protection of rights. We will share personal information if we have a good faith belief that (i) access, use, preservation or disclosure of such information is reasonably necessary to satisfy any applicable law, regulation, legal process, such as a court order or subpoena, or a request by law enforcement or governmental authorities, (ii) such action is appropriate to enforce the Terms of Use for the PointMMO Features and/or the End User License Agreement for the PointMMO Plugin, including any investigation of potential violations thereof, (iii) such action is necessary to detect, prevent, or otherwise address fraud, security or technical issues associated with the PointMMO Features, or (iv) such action is appropriate to protect the rights, property or safety of PointMMO, its employees, users of the PointMMO Features or others.
- Asset transfers. If we become involved in a merger, acquisition or other transaction involving the sale of some or all of PointMMO's assets, user information, including personal information collected from you through your use of the PointMMO Features, could be included in the transferred assets. Should such an event occur, we will use reasonable means to notify you, either through email and/or a prominent notice on the Site(s).
- Service Providers. We may share your personal information with service providers that we engage for the purpose of processing information on our and your behalf. For example, we may partner with other companies to maintain or manage the PointMMO Features. Additionally, we may partner with other companies to process consumer surveys, fulfill prizes, or to process, analyze, and/or store data. While providing services for us, these companies may access your personal information. To the extent applicable, we require these entities to comply with this Privacy Policy and appropriate confidentiality and security measures.
- Publishers. We do not share your personal information with Publishers of the Games you obtain through the Site(s), unless such information has been made anonymous for the purpose of analyzing and improving our respective services, or to the extent sharing such information is necessary to resolve a technical issue with the Games or PointMMO Plugin. When obtaining Games through the Site(s), in addition to signing up for a Site Account, you will be required to separately provide information to the Publisher of each applicable Game in order to play that Game. Additionally, you may be asked by the Publishers to provide certain information in and in association with the Games (e.g., product registration information). Any such information that you provide directly to a Publisher will be subject to the terms and conditions of the privacy policy of that Publisher and we will not have access to such information.
- Overwolf. If you download Overwolf from our Site(s) you will be able to access certain additional features directly through Overwolf, including access to your Third Party Accounts while playing the Games. We do not share any of your personal information with Overwolf Ltd., the operator of Overwolf, and we cannot access any information you provide through Overwolf unless you post such information publicly on our Site(s) through functionality provided in Overwolf. All information you provide to Overwolf Ltd. will be subject to Overwolf Ltd.'s privacy policy.
- Third Party Accounts. To the extent you associate your Third Party Accounts with your Site Account, your browser may automatically send certain information to the companies providing such Third Party Accounts. The information collected by such companies is subject to the separate privacy policies of the companies providing such Third Party Accounts.
- Marketing Partners. We may from time to time share information with third party marketing partners for special promotions or product opportunities, including the Publishers, Social Ingot, and Overwolf. In the event we engage in such activities, we will notify you that the information will be shared and provide you with an opportunity to opt out.
Additional Information You Should Know About Third Parties
This Privacy Policy does not cover the information practices of third party websites linked to the Site(s), including the Games, Social Ingot, Overwolf, or the Third Party Accounts, or their operators. Although we encourage such third parties to adopt and follow their own privacy policies, we are not responsible for their collection and use of your personal information. You should refer to the privacy policies and statements of other websites or software or contact the respective webmasters of those websites or operators of the software to obtain information regarding their information collection, use and disclosure policies. When you have clicked on an advertisement or third party logo displayed on our Site(s) which links you to a different website, our Privacy Policy no longer applies and you must read the privacy policy of the advertiser to see how your personal information will be handled on their website. The PointMMO Features may also have message boards, forums, chat areas, message feeds and/or other sharing features, where users can exchange ideas and communicate with one another. When you post to a message board, forum, chat area, message feed or other sharing feature, please be aware that the information you post along with your username is made publicly available on-line and you do so at your own risk. Additionally, you will be given the opportunity to opt-in to the Social Network. If you opt-in to the Social Network, your name, profile pictures, user name, friends list, other information in your profile, and any posts or information you share through social media features will be made publicly available through the Social Network on-line at your own risk. If you would like us to remove your publicly available information, you can cancel your Site Account by chosing to delete your account in the options settings.
What choices do you have about the collection and use of your personal information?
Control of Your Information
You may update or delete your personal information or modify your Site Account preferences for the PointMMO Features by accessing the "My Account" area of the PointMMO Features. For instance, you will given the option to limit the information you share through the Social Network just to your friends or just to registered users. Additionally, you can delete any information provided by the Third Party Accounts through your account options by http://www.pointmmo.com/members/edit/profile. Please note that when you delete your account, in some cases we may not be able to delete all of your personal information and we may retain your account information afterward for the purpose of internal account management, to comply with our legal obligations, to resolve disputes, to enforce our agreements, and in furtherance of fraud prevention activities.
Opting Out of Receiving Communications from Us and Our Sharing of Your Personal Information
If you no longer want to receive our newsletter, e-mails or other announcements, you may unsubscribe by selecting "unsubscribe" in your account, writing to us at support@pointmmo.com or replying to the unsubscribe link at the bottom of our e-mails. If you have opted into us providing certain personal information to third party marketing partners, you can opt-out from us sharing such personal information in the future to such marketing partner by either emailing us at support@pointmmo.com or selecting "unsubscribe" in your account. Please note that you cannot unsubscribe from certain correspondence from us, including messages relating to your Site Account transactions.
Mediation
If you are a resident of a country outside of the European Union, you also agree that, in the event any dispute or claim arises out of or relating to this Privacy Policy that you and PointMMO will attempt in good faith to negotiate a written resolution of the matter directly between the parties. You agree that if the matter remains unresolved for forty-five (45) days after notification (via certified mail or personal delivery) that a dispute exists, all parties shall join in mediation services in Singapore with a mutually agreed mediator in an attempt to resolve the dispute. Should you file any arbitration claims, or any administrative or legal actions without first having attempted to resolve the matter by mediation, then you agree that you will not be entitled to recover attorney's fees, even if you would otherwise be entitled to them.
Dispute Resolution for Residents of the European Union
If you are a resident of the European Union, in the event that you have any dispute or claim arising out of or relating to this Privacy Policy, you may report your claim to the European Union Data Protection Authorities located in your jurisdiction.
What security measures do we take to safeguard your personal information?
The personal information that you provide to us is stored on servers, which are located in secured facilities with restricted access, and protected by protocols and procedures designed to ensure the security of such information. In addition, we restrict access to personal information to PointMMO employees who need to know this information in order to develop, operate and maintain the PointMMO Features. All PointMMO personnel who have access to this information are trained in the maintenance and security of such information. However, no server, computer or communications network or system, or data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect user information, we cannot ensure or warrant the security of any information you transmit to us or through the use of any of the PointMMO Features and you acknowledge and agree that you provide such information and engage in such transmissions at your own risk. Once we receive a transmission from you, we will endeavor to maintain its security on our systems.
California Residents
Under California law, our users that are California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. As detailed above, we do not share our user's personal information with unaffiliated third parties for direct marketing purposes without giving them the option to opt out.
Notification of Changes
This Privacy Policy may change from time to time and we will post all changes on this page.
